Privacy notice

At Bright Wealth we respect your privacy and the confidentiality of your personal information.

Who we are

Bright Wealth is a trading style of Lyncombe Consultants Limited, which is part of the Adviser Services Holdings Limited (ASHL) group of companies.

Bright Wealth provides financial planning and advice through experienced, qualified advisers based in the UK.

Bright Wealth and Lyncombe Consultants Ltd decide together how and why we use the personal data involved in giving you advice. This makes us ‘joint data controllers’ for that core advice work, so we are both responsible for looking after your data and following the rules. For some activities — such as our own direct marketing — Bright Wealth is solely responsible.

What personal information we collect

Personal information includes your name, address, or phone number and other information that isn’t otherwise publicly available. We collect personal information about you when you contact us about products and services, visit a financial adviser, visit a website we may have or register to receive one of our newsletters (if applicable).

The type of personal information we collect will depend on the purpose for which it is collected and includes:

• Contact details
• Information to verify your identity
• Family, lifestyle, health and financial information
• Payment details

We collect personal information directly from you. For example, we ask for it when we first start working together and later on, to check your identity and protect you from fraud. This is a legal requirement, and it helps protect you from crime.

The enquiry form on this website

If you send us a message using the form on our contact page, we receive the name, email address, phone number, topic and message you type in. That enquiry is emailed to our advisers and is not stored in any database on this website. We also send a short acknowledgement to the email address you provide; it confirms receipt but does not repeat your message or other financial information. We record the internet (IP) address the message was sent from so that we can investigate misuse of the form. Our lawful basis for that is our legitimate interest in keeping the site secure. If the adviser email cannot be delivered we keep a copy on the server so your enquiry is not lost, in a location that is not reachable from the web, and we delete it once we have replied to you.

Special category information

Sometimes we need to collect more sensitive information, such as details about your health or lifestyle. This is called special category data, and we collect it so we can give you financial advice. We will always ask for your consent during the advice process, and explain what we need and why. We always process and store this information securely. You can withdraw your consent at any time — though this may mean you can no longer use the service or product the information was collected for.

Cookies and your choices

When you first visit this site you are asked what you are happy for us to use. Nothing optional runs until you choose, and declining is exactly as easy as accepting. You can change your mind at any time using the Cookie preferences link at the foot of every page.

There are four categories:

• Essential Cookies. We store your cookie choice on your own device so we can honour it on your next visit. This cannot be switched off — without it we would have to ask you again on every page.
• Functional Cookies. The location map on our contact page is provided by Google. It never loads unless you allow this category or choose to load the map once.
• Analytics Cookies. This choice controls Google Analytics 4. It does not load unless you allow this category.
• Marketing Cookies. We do not currently use marketing or advertising cookies, so this category is shown as unavailable.

This website does not use advertising cookies. Your cookie choice is kept in your browser’s local storage, not in a cookie.

How we measure how the site is used

We use Google Analytics 4 to understand how visitors find and use this website. It loads only after you allow Analytics Cookies. We use the information to improve our pages and understand whether visitors can find the information they need.

• Consent first. Analytics storage is denied by default, and the Google Analytics tag activates only after you allow Analytics Cookies.
• What is measured. This may include pages viewed, approximate location, device and browser type, links clicked, and interactions with forms.
• Personal information is excluded. We do not intentionally send names, contact details, financial information or anything typed into the enquiry form to Google Analytics. Email redaction is enabled as an additional safeguard.
• Limited retention. User-level and event-level Analytics data is retained for 14 months.
• No advertising use. Advertising and marketing storage remain disabled.

You can withdraw analytics consent at any time through Cookie preferences. Google provides more information about its use of Analytics data at How Google uses information from sites or apps that use its services. Separately, we keep a basic count of enquiries received — a date and the topic chosen, with nothing that identifies the sender.

For general information about cookies visit www.aboutcookies.org or www.allaboutcookies.org.

Data retention

We keep your personal information only for as long as we need it for the purpose we collected it, and to meet legal and regulatory requirements. When we no longer need it, we dispose of it securely, following our Data Retention and Disposal Schedule. You can ask for a copy of that schedule using the contact details below.

On what basis do we collect data?

We are allowed to process your personal data under several ‘lawful bases’. We process the data we need to provide our products and services because we have a contract with you. We carry out marketing because we have a ‘legitimate interest’ in doing so. You also have rights, listed below, that affect how we can use your data.

How we use your personal information

We process your information to support and maintain our contractual relationship with you, and to meet legal and regulatory requirements. This includes the following:

• Providing our advice, products or services to you
• Carrying out transactions you have requested
• Confirming and verifying your identity for security purposes
• Credit scoring and assessment, and credit management (where applicable)
• Detecting and preventing fraud, crime, money laundering or other malpractice

We also process your data for specific business purposes to enable us to give you the best products and services and the best and most secure experience. For example, we process your information to send you marketing that is tailored to your interests. Our business purposes include the following:

• Enhancing, modifying, and personalising our services for the benefit of our customers
• Providing communications which we think will be of interest to you
• Market or customer satisfaction research or statistical analysis
• Audit and record keeping purposes
• Enhancing the security of our network and information systems

You have the right to object to this processing if you wish — please see “Your rights” below. Please bear in mind that if you object this may affect our ability to carry out the tasks above for your benefit.

We may also process your personal data as part of an acquisition or sale. Should this happen, you will be notified about any change to processing or data controller arising as a result of this activity.

Who we share your information with and why

We share your information with trusted third parties who perform tasks for us and help us to provide the services you require. These include:

• Lyncombe Consultants Limited
• Other adviser firms in the network for the purpose of providing you with advice (with your knowledge)
• The ASHL Group of companies to enhance the services and products we can offer you
• Third parties to verify your identity, in line with money laundering or other requirements (this may involve carrying out checks with credit reference databases)
• Third parties who perform tasks for us to help us set up or service your plan (these third parties may be based in countries outside the European Economic Area (EEA) but where they are, we’ll undertake an assessment of safeguards in place)
• Other organisations, including regulatory bodies, the police and fraud prevention agencies, to prevent and detect fraud
• Third parties where required by law, court order or regulation
• Third parties as part of an acquisition or sale

How we keep your information secure

We are committed to keeping the personal information we hold confidential. We regularly review our security controls, policies and procedures to keep your information secure.

When we contract with third parties, we impose appropriate security, privacy and confidentiality obligations on them to ensure that personal information is kept secure.

If we work with third parties in countries outside the EU, we make sure either that the European Commission has confirmed the country has an adequate level of protection, or that the organisation receiving your data has provided adequate safeguards. In limited cases, your data may be accessed from outside the EEA — for example, by our staff when they travel. When that happens, we make sure appropriate security measures are in place to protect your information.

Your rights

We try to be as open as we can about the personal information we hold, so we have set out your rights below. We have kept this notice short and clear. For more detail, please contact us using the details below, or read about your data protection rights on the ICO website.

Marketing

You have the right to opt out of receiving marketing information and tell us what your communication preferences are by contacting Bright Wealth using the details provided at the end of this notice or by using the opt out option on any email marketing. You may opt out at any time if you don’t want to receive any further communications of this nature.

Individual data rights and requests

• The right to be informed — you can request that we provide ‘fair processing information’, typically through this privacy notice
• The right of access — you may request a copy of the personal information we hold about you using the contact details at the end of this privacy notice
• The right to rectification — the accuracy of your personal information is important to us. You have the right to ask us to update or correct your personal information
• The right to erasure — you may request the deletion or removal of personal data where there’s no compelling reason for its continued processing
• The right to object — you may object to the processing of your data based on legitimate interests
• The right to restrict processing — you have a right to request we ‘block’ or suppress processing of your personal data
• The right to data portability — you may request to obtain and reuse your data
• The right not to be subject to automated decision-making, including profiling

If you wish to correct, restrict, delete or make changes to your personal information, or any of the data subject rights listed above, please contact us using the details below.

This website is operated by Bright Wealth, a trading style of Lyncombe Consultants Limited, registered in England and Wales under company number 06030940. Our registered address is The Brookdale Centre, Manchester Road, Knutsford, WA16 0SR. Our office address is Subani House, Old Stafford Road, Slade Heath, Wolverhampton WV10 7PJ. You can reach us on 0345 460 4444 or at info@brightwealth.co.uk.

Our regulatory status

Lyncombe Consultants Limited is authorised and regulated by the Financial Conduct Authority under firm reference number 618025. You can check this on the Financial Services Register at register.fca.org.uk. Our permitted business is advising on and arranging pensions, investments, protection and mortgages.

Who this website is for

The information on this site is directed only at people resident in the United Kingdom. It is not an offer or invitation to anyone in a jurisdiction where doing so would breach local law or regulation. If you access this site from outside the UK, you do so on your own initiative and are responsible for complying with the laws that apply to you.

Information, not advice

Everything on this website — including our articles, service descriptions and calculators — is general information. It is not personal advice and it is not a personal recommendation. Nothing here takes account of your own circumstances, objectives or needs.

You should not make, or refrain from making, any financial decision on the basis of this website alone. Personal recommendations are given only after we have gathered enough information about you to assess suitability, and are always confirmed to you in writing.

Investment and product risks

The value of investments and the income from them can fall as well as rise. You may get back less than you invested. Past performance is not a reliable indicator of future performance.

The tax treatment of any product depends on your individual circumstances and may change in future. Levels and bases of taxation, and any reliefs available, can change.

Your home may be repossessed if you do not keep up repayments on your mortgage.

Calculators and tools

Our calculators are provided to help you explore possibilities. They rely on assumptions and on the figures you enter, and they simplify a great deal. Their results are estimates and illustrations only — not forecasts, guarantees or advice. Actual outcomes will differ. Please speak to an adviser before acting on anything a calculator shows you.

Accuracy and availability

We take care to keep this website accurate and up to date, but we do not warrant that it is complete, current or error-free. Tax rates, allowances and rules change, and pages may not reflect the latest position at the moment you read them.

We do not guarantee that the site will always be available or uninterrupted. We may suspend, withdraw or change any part of it without notice.

Links to other websites

Where we link to other websites, we do so for information only. We have no control over their content and accept no responsibility for it. A link does not imply that we endorse the site, its operator or anything offered on it.

Intellectual property

The content of this website — text, images, logos, layout and design — is owned by or licensed to us and is protected by copyright and other rights. You may view, download and print pages for your own personal, non-commercial use. You may not reproduce, republish, distribute or exploit any part of the site commercially without our written permission.

Acceptable use

You agree not to use this site unlawfully, and not to attempt to gain unauthorised access to it, introduce malicious code, or interfere with its operation or with anyone else's use of it.

Contacting us electronically

Email and web forms are not secure. Please do not send us bank details, card numbers, National Insurance numbers or other sensitive information through this website. We cannot accept responsibility for information intercepted or lost in transit. If you need to send us something sensitive, please call us first and we will arrange a secure method.

An enquiry sent through this website does not create a client relationship. We will only begin advising you once we have agreed terms of business with you in writing.

Our liability

We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded — including any liability arising under the regulatory system.

Subject to that, we are not liable for any loss or damage arising from your use of, or reliance on, this website or its content, or from your inability to use it.

If something goes wrong

If you are unhappy with our service, please tell us — write to us at Subani House, Old Stafford Road, Slade Heath, Wolverhampton WV10 7PJ, or call 0345 460 4444. We will acknowledge your complaint promptly and let you know how we will handle it.

If we cannot resolve matters to your satisfaction, you may be able to refer your complaint to the Financial Ombudsman Service at www.financial-ombudsman.org.uk. We are also covered by the Financial Services Compensation Scheme; you may be entitled to compensation from the scheme if we cannot meet our obligations. Details are available at www.fscs.org.uk. What is covered, and the limits that apply, depend on the type of business.

Your personal information

How we handle your personal information is set out in our privacy notice above.

We may update these terms from time to time. The version published here is the one that applies, so please check it when you use the site.
